Selling an investment property
Selling a rental has extra things to line up, especially if there are tenants. Here is what to think about and how we help.
Investment properties are often sold with tenants in place, and the sale has to work around the tenancy. The Residential Tenancies Act sets rules about notices and access, and Tenancy Services (tenancy.govt.nz) publishes guidance for landlords and tenants.
We will plan open homes and viewings with you around your tenants, and explain who is likely to buy: owner-occupiers, other investors, or both.
How we help
- An appraisal that takes the property's condition and tenancy into account
- A marketing plan with viewings arranged around the tenants
- Advice on whether to sell with tenants in place or vacant, which you should also discuss with your lawyer
- Regular updates and negotiation on your behalf
- Referring you to your lawyer and accountant for the legal and tax side
Get legal advice. This page is general information only and is not legal, tax or financial advice. Your lawyer, and where relevant your accountant or bank, can advise on your own situation before you sign anything.
Things to think about
General guidance only. For advice on your property, speak to your lawyer.
Tenancy
Check the type of tenancy and its dates with your lawyer. A sale does not automatically end a tenancy.
Access for viewings
Notice and access rules apply to tenants. We will plan viewings with you so tenants are given proper notice.
Tax
Tax rules on property sales are for your accountant. Ask them before you list.
Finance
Ask your bank about any costs to repay the loan on the property.
Questions
Can I sell with tenants in place?
Often yes, but the details depend on the tenancy. Check with your lawyer, and we will plan viewings around the tenants.
Do I need to tell my tenants?
There are rules about notice and access. See tenancy.govt.nz and ask your lawyer.
Who should I talk to about tax?
Your accountant. We can give you the sale information they ask for, but we do not give tax advice.
