Selling a deceased estate

Selling a property after someone has died can be hard. We aim to make the practical side clear and unhurried, and to work alongside your lawyer.

When a property is part of a deceased estate, the person with legal authority to sell is normally the executor named in the will, or an administrator if there is no will. Your lawyer will tell you what authority you need before the property can be sold, and who must sign the documents.

Our part is the sale itself: an appraisal, a plan for marketing the home, and keeping you and your lawyer informed along the way.

How we help

  • A free appraisal, with no obligation to list
  • Clear explanations at each step, so family members who are not in Auckland can follow along
  • Working with the estate's lawyer on timing and paperwork
  • Advice on preparing the property, which may include clearing it
  • Conversations in English, Punjabi, Hindi, Mandarin, Urdu or Arabic

Get legal advice. This page is general information only and is not legal, tax or financial advice. Your lawyer, and where relevant your accountant or bank, can advise on your own situation before you sign anything.

Things to think about

General guidance only. For advice on your property, speak to your lawyer.

Start with your lawyer

Before the property is listed, your lawyer will confirm who has authority to sell and what documents are needed.

Several decision-makers

If more than one person is involved in decisions, agree how you will give instructions. A single point of contact keeps things simple.

The state of the property

The home may need clearing, cleaning or repairs. We can tell you what is worth doing before sale, and what is not.

Take your time

There is no rule that you must list straight away. Many families prefer to talk it through first, and an appraisal carries no obligation.

Questions

Who can sell a property in an estate?

Normally the executor or administrator, once they have the legal authority to deal with the property. Your lawyer will confirm this.

Do I have to list straight away?

No. A free appraisal does not oblige you to list, and your lawyer can advise on timing.

Can you work with the estate's lawyer?

Yes. We are used to working with lawyers on timing, documents and settlement.
